1. About These Terms
These Terms and Conditions apply to all services provided by Bodhi Legal, a legal practice registered and operating under Thai law, with offices at 268 Wireless Road, Lumphini, Pathumwan, Bangkok 10330, Thailand.
By engaging our services or using this website, you confirm that you have read and understood these terms. They form part of the engagement agreement between Bodhi Legal and each client.
Where a separate engagement letter is issued, its specific terms take precedence over these general terms to the extent of any inconsistency.
2. Services We Provide
Bodhi Legal provides specialist pension legal defence services. Our current service range includes:
- Documentary Review and Eligibility Assessment — a careful review of pension records, employment history, and decision correspondence, resulting in a written eligibility timeline and a plain-language summary of apparent entitlement.
- Pension Reinstatement Support — assistance for clients whose pension payments have been suspended, reduced, or withdrawn, including preparation of formal correspondence and liaison with the relevant pension authority.
- Tribunal Hearing Representation — full representation at a formal administrative tribunal, including evidence preparation, written submissions, and attendance at the hearing.
The scope of each engagement is defined in the engagement letter issued at the outset of each matter. Work falling outside that scope will be discussed with the client separately before being undertaken.
3. Engagement and Instructions
No advisory relationship is formed and no work is commenced until an engagement letter has been signed by both parties. Signing or returning the engagement letter, whether in paper or by clearly expressed written agreement, constitutes the client's acceptance of the scope, fee, and conditions described therein.
Instructions should be given in writing wherever possible. Where instructions are communicated verbally, we will confirm them in writing to avoid misunderstanding. Clients are encouraged to retain copies of all correspondence.
We accept instructions from the client directly, or from a person with written authority to act on the client's behalf, such as a family member holding a valid power of attorney.
4. Fees and Payment
Fees for our standard services are set out on this website and in the engagement letter. All amounts are stated in Thai Baht (฿). The applicable fee is that confirmed in the engagement letter at the time of instruction.
Payment terms
- Payment is due as stated in the engagement letter. For most services, an initial payment is required before work commences, with any balance due on completion or at milestones as agreed.
- Payments may be made by bank transfer. Details are provided in the engagement letter.
- Where a matter requires unexpected additional work beyond the agreed scope, this will be discussed with the client before proceeding. Any additional fee will require the client's written agreement.
Expenses
Where a matter requires third-party expenses — such as official document fees, certified translation, or postal charges — these will be identified in advance and, where not included in the fixed fee, billed at cost to the client on presentation of receipts.
Non-payment
If an invoice remains unpaid beyond the agreed payment date, Bodhi Legal reserves the right to pause work on the matter until payment is received. The client will be notified in writing before any such pause takes effect.
5. What We Need From You
The quality of our work depends on the accuracy and completeness of the information and documents you provide. You agree to:
- Provide accurate information to the best of your knowledge, and to inform us promptly if you become aware that information previously given was incorrect or incomplete
- Provide relevant documents as requested, including pension correspondence, employment records, and identity documents
- Notify us of any change in your address, telephone number, or email address during the course of an engagement
- Respond to requests for instructions or information within a reasonable time, which we will specify if the matter is time-sensitive
We are not responsible for difficulties or adverse outcomes that arise directly from incomplete or inaccurate information provided by the client.
6. Confidentiality
All information shared with Bodhi Legal in the course of an engagement is treated as strictly confidential. We will not disclose client information to any third party without the client's prior written consent, except:
- Where disclosure is required by Thai law or a court order
- Where disclosure to pension authorities is necessary and directly authorised by the client as part of the agreed service
- Where professional interpreters or other service providers have been engaged on the client's behalf under a confidentiality obligation
This obligation of confidentiality continues after the conclusion of an engagement.
7. Limitation of Liability
Bodhi Legal will carry out its work with reasonable care and skill. However, we cannot and do not accept responsibility for the following:
- Decisions made by pension authorities or tribunals, which are independent of our practice
- Outcomes that depend on factors outside our control, such as the availability of records, the decisions of third parties, or changes in applicable regulations
- Loss arising from instructions or information that were inaccurate, incomplete, or provided late by the client
- Indirect or consequential losses
Nothing in these terms excludes liability for matters that cannot lawfully be limited, including liability for fraud or wilful misconduct.
Where our liability does arise, it is limited to the total fees paid by the client for the specific service from which the claim arises.
8. Intellectual Property
All written work products produced by Bodhi Legal — including assessment documents, correspondence drafts, and written submissions — are provided for the personal use of the client in connection with their pension matter. They may be shared with family members and other advisers involved in the matter.
Documents may not be copied, reproduced, or used for any commercial purpose without our prior written consent.
